Section 109
Witness understanding through audio-visual communication (video conference)

(1) If the witness required to be examined according to this paragraph is physically disabled or a child or cannot be brought to the court due to security reasons, the concerned party may apply to the court to examine such witness through audio-visual communication (video conference).
(2) If the court orders that the examination of a witness of a certain nature be conducted through audio visual communication (video conference), the witness shall be examined accordingly.
(3) If an application is received as per sub-section (1) and if the reason mentioned in the application is found to be reasonable or if the court orders as per sub-section (2), notwithstanding anything written elsewhere in this code, the court may understand such witness through audio-visual communication (video conference).
(4) According to sub-section (3), during the audio-visual dialogue (video conference), the relevant party of the case may appear at the place of such dialogue and ask, cross-examine or re-interrogate after taking the permission of the court.
(5) According to sub-section (3) when a witness is heard, arrangements should be made to record the statements made by such a witness and the court should keep a record of the audio-visual communication (video conference).
(6) The record of witness understanding through audio-visual communication (video conference) shall be kept in the format as per schedule-40.
